General rental conditions

The "Equipment Rental" service is provided by ALSACE GRAVEL BIKE (hereinafter referred to as the rental company). The rental conditions are an integral part of the rental agreement. By accepting the general conditions, the lessee confirms having read and fully accepted the rental conditions.

1. Equipment Collection

The lessee accepts the equipment in good working order. The lessee is required to make any complaints to the rental company at the time of equipment collection (departure inventory).

You must pick up your bike at the exact time indicated on your rental agreement. In the event of an unannounced delay of more than 30 minutes, your reservation may be cancelled without refund and your bike reassigned.

2. Equipment Return

The lessee is required to return the equipment to the rental company at the end of the rental period defined in the rental agreement (time, date, place).

  • A late return of a half-day rental will result in an additional half-day rental charge for all rental items (bicycle and accessories).

  • A late return of a full-day rental will result in an additional full-day rental charge for all rental items (bicycle and accessories).

The equipment and all accessories provided by the rental company (helmets, etc.) must be returned to the rental company in perfect condition. If the lessee loses or damages accessories, they will be charged. Material damage is charged at the published rates (price list for damages caused to the bicycle and accessories).

2.1. Breakdowns and Flat Tires

The customer is responsible for the bicycle for the entire duration of the rental. In the event of a breakdown, he/she agrees to return it to the rental location, as no roadside assistance is provided. In the case of a flat tire, the repair costs are the responsibility of the customer, whether the repair is carried out by a bicycle shop or by Alsace Gravel Bike (according to the price list). The customer may replace an inner tube himself/herself, provided he/she has the necessary skills and does not damage the bicycle. Any breakage or damage remains the responsibility of the customer.

3. Extension of the Rental Term

An extension of the rental agreement is only possible with the lessor's consent before the end of the current rental agreement. The lessor may refuse this extension without giving a reason.

4. Minimum Age of the Lessee

The lessee must be of legal age.

5. Services and Prices

The valid prices are those published by the rental company and in its brochures.

6. Insurance

Insurance is the responsibility of the lessee. By signing the rental agreement, the lessee confirms that they have adequately covered the risks associated with the use of the equipment. The equipment is not insured against theft and breakage.

 

7. Helmets

An approved helmet is available for rental. In France, wearing a helmet is mandatory for children under 12 years of age.

 

8. Lessee's Liability

The lessee agrees to use the rented equipment with caution, without endangering third parties, and in accordance with the attached safety instructions. The lessee is always liable for any bodily injury or property damage caused while using the rented equipment (Articles 1383 and 1384 of the Civil Code). ALSACE GRAVEL BIKE shall not be held liable under any circumstances for any damage or loss suffered or caused by the lessee while using the rented equipment. Use in competition or for conduct similar to a competition is prohibited. In the event of damage due to an accident, loss, theft, or improper handling of the equipment, the lessee is responsible for the repair costs. In the event of total damage or loss, the lessee is responsible for the replacement value of the equipment.

 

9. Security Deposit

The lessor requests a credit card imprint as a security deposit against loss, theft, or damage to the equipment.

 

10. Cancellation

  • If you cancel more than 96 hours (4 days) before the start of your reservation, you will receive a 100% refund of the total reservation amount, less a 5% processing fee.

  • If you cancel between 24 and 96 hours before the start of your reservation, you will receive a 50% refund of the reservation amount.

  • Finally, if you cancel less than 24 hours before the start of your reservation, no refund will be issued.

 

11. Governing law

This contract is subject to French law. In the event of a dispute, in order to confront the points of view of third parties and allow them to find a solution to the dispute themselves, a mediator may be appointed by the parties or the previously appointed judge. This mediation may then take two possible forms: conventional or judicial. In the event of mediation first and failure to resolve the dispute, the competent court by default would be that of the final lessee of the equipment. Upon agreement, or in the case of different lessees and possible victims of damage, a single common court may be determined by the courts.
